Eureka Officers Viciously Beat Martin and Left Him to Die in Jail Cell
Eureka, CA: A jury delivered a resounding victory for plaintiffs in a police misconduct civil rights case by awarding the total sum of $4,575,000 against the City of Eureka and Eureka police officers Adam Laird, Justin Winkle, and Gary Whitmer for the death of Martin Cotton II. Punitive damages were assessed against the three officers. Mr. Cotton, a 26 year-old man living on the streets died of blunt force head trauma. The plaintiffs, represented by attorneys Dale K. Galipo and Vicki I. Sarmiento of Los Angeles County, were Mr. Cotton's 5 year-old daughter and his father. The jury found that Officers Laird and Winkle used excessive force, and that all three officers failed to provide medical care.

Approximately seventeen people have been charged over the past three weeks with crimes related to the protests against former BART cop Johannes Mehserle's involuntary manslaughter verdict on July 8th. Some of those recently charged were arrested that night, while others have been identified by police in photos, and have been newly arrested. The latest set of arraignments on Monday morning saw three Oaklanders charged with Unlawful Assembly, Remaining at the Scene of a Riot, and Rioting. They are set to reappear in court within the next month.

"...Marcus J. Suhn was convicted of disorderly conduct for yelling profanities at a passing police car in Brookings, South Dakota. He appeals his conviction and contends that his utterances are protected speech under the First and Fourteenth Amendments to the United States Constitution. The State argues that Suhn’s utterances fall under the “fighting words” exception to First Amendment protection. We hold that Suhn’s words are protected speech and reverse."
